What do MLAs and MLCs do?

An MLA sits in a Legislative Assembly. An MLC sits in a Legislative Council where one exists.

An MLA is a Member of a state's Legislative Assembly. An MLC is a Member of its Legislative Council. Not every state has a Council, and the two Houses are not interchangeable. Articles 168–171 establish the framework for state legislatures and Councils. 1

Assembly and Council

The Assembly is the directly elected House. A Council has a different composition and selection arrangement under Article 171. Do not describe every MLC as someone elected directly by all voters in an ordinary Assembly constituency. 1

The state's Council of Ministers is collectively responsible to the Legislative Assembly. When discussing whether a state government retains legislative confidence, distinguish that Assembly relationship from the role of the Council. 2

They do not have identical powers over Bills

The Constitution gives Legislative Councils a more limited role than Assemblies in specified legislative procedures. Articles 197 and 198 govern the Council's role for ordinary Bills and Money Bills. A Council's disagreement is not a permanent veto over every Assembly Bill. 3

That does not mean its proceedings are unimportant. Ask what it examined, what concerns were raised and how the government answered, rather than assuming the two Houses must perform the same job to be useful.

A representative is not the whole administration

For a hypothetical state-run hospital problem, an MLA may be a relevant representative to approach. You should still identify the hospital administration, responsible department and specific service failure. The representative and the operating authority are different recipients for different questions.

Ask the representative about action taken with the government. Ask the service authority about staffing, a complaint or the relevant operational record. Do not substitute a political assurance for evidence that the problem was resolved.

Check your state's actual arrangements

Use the official legislature website for current membership, constituency information and available proceedings. Under Article 169, Parliament may create or abolish a Legislative Council by law after the State Assembly passes a resolution supported by a majority of its total membership and at least two-thirds of members present and voting. The resolution alone does not create or abolish the Council. Such a law is not treated as an Article 368 constitutional amendment. Check the legislation’s commencement and the currently operating institution. 4

For readers in Union Territories, use the legislature and administrative arrangements that actually apply there. A state explainer is not automatically a guide to every Union Territory.
