Lok Sabha and Rajya Sabha: why two Houses?

The two Houses have different representative structures and different powers in some procedures.

Research checked · 2 min read · v2.0.0

Lok Sabha and Rajya Sabha are the two Houses of India's Parliament. The constitutional definition of Parliament also includes the President. The Cabinet is not a third House. 1

Who is represented?

Lok Sabha is the House of the People. Its electoral system lets voters choose representatives in territorial constituencies. Under first-past-the-post, the candidate with the most votes in a constituency wins that seat. 2

Rajya Sabha is the Council of States. Elected state representatives are chosen by elected members of the relevant Legislative Assembly using proportional representation through the single transferable vote. Its composition also includes nominated members under the Constitution. It is not another nationwide direct election on the Lok Sabha model. 3 1

Why the distinction matters

For ordinary legislation, both Houses have roles in passing a Bill. Disagreement can involve constitutionally specified procedures; it is inaccurate to treat a vote in one House as automatically completing the entire process. Money Bills follow a different procedure, with Rajya Sabha making recommendations within the prescribed constitutional window rather than exercising the same powers as Lok Sabha. 4 5

The Union Council of Ministers is collectively responsible to Lok Sabha. That gives the confidence of Lok Sabha a particular role in whether the government can remain in office. This does not make Rajya Sabha irrelevant to scrutiny or lawmaking. 6 7

Their terms work differently

Rajya Sabha is not dissolved; approximately one-third of its members retire every second year under the constitutional arrangement. Lok Sabha ordinarily has a five-year term from its first meeting unless dissolved sooner, with an exceptional constitutional provision for extensions during an Emergency. A House's term and an individual vacancy are different things. 8

Read a parliamentary headline precisely

In a hypothetical example, “Bill clears Rajya Sabha” tells you one stage. To understand what happened, ask whether Lok Sabha has passed the same text, whether special procedures apply and whether assent and commencement have occurred.

You do not need live seat counts to understand these distinctions. For current membership or a particular Bill, use the official parliamentary record and attach the date you checked it.
